Stafford Towbars Ltd: Terms and Conditions of Sale and Service
1.0 General
1.1 Stafford Towbars Ltd (hereinafter referred to as "the Seller" or "the Company").
1.2 Terminology:
"Buyer" or "Customer" is the person or business placing an order for goods or services.
"Goods" refers to towbars, electrics, or parts supplied.
"Services" refers to installations, inspections, diagnostics, and repairs.
"Order" is the Buyer indicating an intention to purchase.
"Contract of Sale" is formed only once work has commenced or items have been dispatched.
1.3 By placing an order or leaving a vehicle with the Company, the Buyer agrees to all terms and conditions herein. It is the responsibility of the Buyer to understand these terms before completing any transaction.
2.0 Payment and Right of Lien
2.1 Orders and Services will not be considered "settled" until the Buyer has paid the invoice in full.
2.2 Particular Lien: The Company retains a legal "Right of Lien" over any vehicle left in its possession. The Company is entitled to retain the vehicle and keys until all outstanding debts for repairs, parts, and storage are paid in full.
2.3 In the case of payment being withdrawn (chargebacks) following the release of a vehicle, the Company will seek to recover the monetary value plus expenses. Interest will be charged at 8% above the Bank of England base rate.
3.0 Completion and Collection
3.1 The Company will notify the Buyer when a vehicle is ready for collection via the contact details provided.
3.2 It is the Buyer's responsibility to ensure they are available to receive this notification.
4.0 Storage Charges
4.1 The Buyer must collect their vehicle within 14 days of being notified that the work (installation, inspection, diagnostic, or repair) is complete.
4.2 If the vehicle is not collected and the balance is not paid in full within 14 days of the notification of completion, a storage charge of £25.00 per day will be applied.
4.3 This charge applies to all vehicles, including those currently under SORN (Statutory Off Road Notification) or those without a valid MOT.
4.4 The Company will not be held liable for any DVLA fines or seizures if the Buyer attempts to remove a SORN or non-MOT vehicle onto a public highway.
5.0 Uncollected Goods
5.1 Pursuant to the Torts (Interference with Goods) Act 1977, if a vehicle remains uncollected and the debt remains unpaid for a period exceeding 3 months, the Company reserves the right to sell the vehicle at public auction to recover all costs.
5.2 Any proceeds exceeding the debt (repairs + storage + sale costs) will be held for the Buyer.
6.0 Item Listing and Pricing
6.1 Information on Stafford Towbars Ltd listings is provided by manufacturers; the Company is not liable for data inaccuracies. Fitting instructions take precedence.
6.2 All prices include VAT at the statutory rate unless otherwise stated.
7.0 Delivery and Dispatch
7.1 For mail-order goods, the Company uses third-party couriers. Once dispatched, transit safety is the responsibility of the courier.
7.2 The Company is not liable for costs incurred by the Buyer due to unforeseen delays in delivery or parts arrival.
8.0 Damaged or Incorrect Items
8.1 It is the Buyer’s responsibility to check goods thoroughly upon delivery or installation.
8.2 Any damage must be reported within 48 hours to Stafford Towbars Ltd.
9.0 Guarantee and Warranty
9.1 All towbars and electrics carry a manufacturer’s warranty. This is void if the unit is tampered with, misused, or used against manufacturer instructions.
9.2 The Company will not accept liability for consequential costs (e.g., vehicle hire, loss of earnings) due to a faulty part.
10.0 Privacy and Data Protection
10.1 Personal information (Name, Address, Phone Number) will be used solely to process the order and maintain service records.
11.0 Force Majeure
11.1 Stafford Towbars Ltd will not be held liable for any delay or failure to fulfill an order through circumstances beyond the Company's control (e.g., natural disasters, supply chain failure).
